TERMS OF USE AND DISTANCE SALE AGREEMENT Returns If you notice any discrepancies or issues with the quality of the product, please contact us within 48 hours of receiving your order by email at shop@rigasteatris.lv or by phone at +371 67304215. In accordance with the Consumer Rights Protection Law of the Republic of Latvia, you may exercise your right of withdrawal within 14 calendar days and return the item purchased from our online store to us. The period for exercising the right of withdrawal begins on the day you receive the item. If you exercise your right of withdrawal, you must deliver the purchased item to the box office of the Riga Independent Theater no later than 14 calendar days from the date you notified us of your decision to withdraw. To notify us of your decision to withdraw, you must send a written notice of withdrawal, along with a copy of the purchase receipt, to the address of the Association “Riga Independent Theater” at 28 Tērbatas Street, Riga, LV-1011, or electronically to the email address shop@rigasteatris.lv. The right of withdrawal cannot be exercised if the item was manufactured according to your specifications or is clearly personalized, if you have opened the item’s packaging, or if it is mechanically and/or visually damaged. When returning a purchased item, the buyer must present a valid form of identification and a document confirming the purchase (e.g., the original sales receipt). Refund Policy The refund for returned items will be transferred to the bank account from which the order was placed within 14 calendar days of the return date. Delivery Information We offer the option to pick up orders at the Riga Independent Theater box office or at any Venipak pickup point throughout Latvia. If you choose to pick up your order at the Riga Independent Theater box office, a theater staff member will contact you as soon as your order is ready for pickup and invite you to come pick it up. Picking up your order at the Riga Independent Theater box office is free of charge. If you choose to pick up your order at one of the Venipak pickup points in Latvia, the delivery time is 5 to 7 calendar days. The delivery fee will be specified when you place your order. Our staff processes orders on business days from 12:00 PM to 4:00 PM. If an order is placed at any other time, it will be processed on the next business day. If we have any additional questions after receiving your order, we will contact you to clarify the details. Distance Contract This contract is entered into between the Association “Riga Independent Theater,” registration No. 40008267099, legal address: 28 Tērbatas Street, Riga, (hereinafter the “Company”), and a natural or legal person (hereinafter referred to as the “Buyer”) who purchases goods from the Company’s online store at www.rigasteatris.lv (hereinafter referred to as the “e-store”). 1. Subject Matter of the Contract A distance contract is an agreement between the Buyer and the Company based on the Company’s offer made via the Internet. The distance contract applies to all orders placed through the Company’s online store. 2. Entry into Force of the Distance Contract The Distance Contract enters into force as soon as the Buyer places an order via the Internet and receives confirmation from the Company, which is automatically generated by the Company via email upon completion of the order. The order and the order confirmation are considered received when they are accessible to the parties to whom they are addressed. 3. General Provisions Regarding Ordering Goods The Buyer may shop at the Company’s online store without prior registration, which does not affect the terms of the Agreement. To place an order in the online store: 1. Next to the item of interest, the Buyer must click the “Buy” button 2. To order the selected item, click the “Buy” field 3. To complete the order, the Buyer must fill out the information regarding the Buyer, delivery, and payment for the purchase. To complete the order process, the Buyer must agree to the terms and conditions listed on the page. After the order is registered, a message confirming the successful placement of the order will be displayed. Orders are processed on business days from 12:00 PM to 4:00 PM. If an order is placed at any other time, it will be processed on the next business day. Upon receipt of the order, the Company will contact the Buyer, if necessary, to clarify any information and/or confirm the order. 4. Payment Terms for Orders The Buyer may pay for purchases made in the online store: • using a debit card issued by a credit institution; • by bank transfer; • using the online banking services of Swedbank, SEB, or Citadele; • in cash upon receipt of the goods. The invoice will include all the information necessary for payment via online banking or at a bank branch. The purchase will be considered paid for, and the goods will be delivered, once the funds have been received in the Company’s bank account. Upon receiving the goods, the Buyer will be issued a delivery receipt, which must be signed to confirm receipt of the goods. 5. Delivery Terms Goods can be picked up: • at the Riga Independent Theater box office during the business hours listed in the online store. Pickup at the Riga Independent Theater box office is free of charge. • At Venipak parcel lockers throughout Latvia. The delivery fee will be specified when the order is placed. The Company reserves the right not to deliver or hand over the goods if the Buyer has not paid for them. Product prices include Value-Added Tax (VAT). The price does not include the delivery fee. The delivery fee may vary depending on the weight, size, and packaging of the shipment. 6. Warranty If the Buyer has any complaints regarding the quality of the purchased goods, the Buyer may contact the Company with the goods and documents confirming payment. If a manufacturing defect is found, the Company undertakes to exchange the goods for a suitable replacement. If a defect is found that was caused by the Buyer during use of the product, the product will not be replaced. 7. Performance Period for the Distance Contract The Company undertakes to fulfill the terms of the distance contract within the territory of the Republic of Latvia no later than 30 calendar days after receiving the order from the Buyer, or in accordance with the deadlines specified by the online store outside the territory of the Republic of Latvia. If the Company is unable to fulfill the contract due to a shortage of the goods ordered by the Buyer, the Company shall notify the Buyer thereof. In such a case, the Company may offer the Buyer an equivalent product. 8. Right of Withdrawal In accordance with the Consumer Rights Protection Law of the Republic of Latvia, the Buyer may exercise the right of withdrawal and unilaterally withdraw from the distance contract within 14 calendar days and return the item purchased from the online store to the Company. The period for exercising the right of withdrawal begins on the day the Buyer receives the product or, if the Buyer has purchased multiple products that are delivered separately, on the day the Buyer receives the last product. If the Buyer exercises the right of withdrawal, the Buyer shall bear the costs associated with returning the item. Pursuant to Section 12, Paragraph 6 of the Consumer Protection Law, the consumer is responsible for maintaining the quality and safety of the goods during the period in which the right of withdrawal may be exercised. The Company reserves the right to deny the Buyer’s right of withdrawal or to charge a compensation fee if the product is damaged, if the product was handled carelessly during use or the instructions were not followed, if the product’s original packaging has been lost, or if the packaging is significantly damaged. The Buyer may not exercise the right of withdrawal if the item is manufactured according to the Buyer’s specifications or is clearly personalized, if the Buyer has played an audio or video recording, if the Buyer has opened the item’s packaging, or if the item is mechanically and/or visually damaged. When returning a purchased item, the Buyer must present a valid form of identification and a document confirming the purchase. The Buyer may return an item that complies with the distance contract within 14 calendar days. 9. Confidentiality The Company undertakes not to disclose or transfer information about the Buyer to third parties without the Buyer’s written consent, except in cases where the laws and regulations of the Republic of Latvia or this contract are violated. 11. Other Provisions By entering the required information and placing an order, the Buyer confirms that they have read and agree that the data they provide will be used so that the Company can accept the Buyer’s order and deliver the goods in accordance with the requirements of the laws and regulations of the Republic of Latvia. By entering this information, the Buyer agrees to receive notifications related to the processing of the Buyer’s order at the specified email address. The Seller reserves the right to inform the Buyer about new products, discounts, and services. 12. Term of the Agreement The Agreement enters into force when the Buyer places an order for the Goods and remains in effect until the contracting parties have fully fulfilled their obligations to one another. 13.
